By joining Queen Elizabeth Tennis Club, you are agreeing to this ACKNOWLEDGEMENT OF RISK, WAIVER, RELEASE, & INDEMNITY

The Queen Elizabeth Tennis Club (QETC) operates the playing of tennis and/or other social activities hosted by QETC. It includes all of the club’s respective officials, executive, volunteers, and suppliers.

Awareness of Risks

I AM AWARE that risks accompany my participation in the club’s activities including, without limitation, the risk of physical harm.

1) I acknowledge that the activity, by its nature, is such that QETC cannot identify all possible risks associated with it or with the social component of participating in club events, with the consumption of food and drink (whether prepared by professionals or by non-professionals); negligence of other participants and non-club members

2) There is no guarantee or any assurance that QETC members, volunteers, or members of the executive involved in the activity will not make errors that might create risks of harm to me therein; or

3) There is no guarantee that QETC members, volunteers, or executive members will be able to protect me from risks associated with the activity, including, without limitation, theft; risks created by others participating in the activity (including the risk of infection); contraction of a contagious disease including, but not limited to, COVID-19;

I DECLARE that I or anyone in my household will not come to QETC if experiencing any cold or flu-like symptoms in the last 14 days. If I or anyone in my household experiences any cold or flu-like symptoms, I will not attend QETC tennis for a minimum period of 14 days after the cold or flu-like symptoms have completely gone away. I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that the people associated with my QETC membership may be exposed to, or be infected by, COVID-19 by coming to QETC. I also acknowledge that such exposure or infection may result in personal injury, illness, permanent disability, and/or death. I understand that the risk of becoming exposed to or infected by COVID-19 may result from the actions, omissions, or negligence of myself and others, including, but not limited to, the QETC executive, volunteers, fellow members, and their families.

IN RETURN FOR QETC ALLOWING ME TO JOIN and PARTICIPATE IN THE ACTIVITY:

1) I NOW WAIVE ALL LEGAL RIGHTS TO SUE AND ANY AND ALL CLAIMS I and my successors and assigns may have against QETC in connection with any loss, injury, damage, or expense of any kind that I may in any way suffer, incur, or experience as a result of, or in connection with, my participation in the club’s activities; and

2) I HEREBY RELEASE QETC from any and all liability for any complaints, demands, claims, actions, suits, judgements, and orders for any and all losses, injuries, damage, or expenses I may suffer, incur, or experience in connection with my participation in attending, playing tennis, and socializing; and

3) I AGREE TO INDEMNIFY QETC for, and hold it harmless from, any and all losses, injuries, damages, and expenses of any kind that I may suffer, incur, or experience and for any and all complaints, demands, claims, actions, suits, judgements, and orders for any and all losses, injuries, damages, or expenses of any kind anyone else may suffer, incur, or experience in connection with my participation as a member.

I NOW FREELY ACCEPT AND ASSUME FULL RESPONSIBILITY FOR ALL RISKS TO ME IN CONNECTION WITH MY PARTICIPATION IN PLAYING TENNIS OR PARTICIPATING IN SOCIAL EVENTS PUT ON BY QETC.
